Our site offers you a catalogue of cosmetic products, sold under the brand name \u00abLUCIA RAPETTI\u00bb, manufactured and marketed by LUCIA RAPETTI, a limited liability company with capital of \u20ac, having its registered office at 4, rue Beaulieu, 06800 Cagnes sur mer - France, registered with the RCS under number 420 223 836.<\/p>

These General Terms and Conditions of Sale are systematically brought to the attention of each potential customer to enable them to place an order on this website, by fax or by telephone.
Consequently, placing an order implies the customer's full and unreserved acceptance of these General Terms and Conditions of Sale, to the exclusion of any other documents, such as brochures or catalogues issued by LUCIA RAPETTI, which are for information purposes only.
Any order for a Product offered on the Site implies consultation and express acceptance of these general terms and conditions of sale, without this acceptance being conditional on a handwritten signature by the user. In accordance with the provisions of articles 1316 to 1316-4 of the French Civil Code, supplemented by Decree no. 2001-272 of 30 March 2001, issued for the application of article 1316-4 of the French Civil Code and relating to electronic signatures, it should be noted that validation of the order form constitutes an electronic signature which has, between the parties, the same value as a handwritten signature and is proof of the completeness of the order and of the payability of the sums due in execution of the said order.<\/p>

ARTICLE 1. OFFERS AND PRICES<\/b><\/p>

Our product offers are only valid for the duration of the offer in question and are subject to availability.

It is specified that any promotions granted in the form of discount vouchers are only valid for one order per household and for a given period of validity.
The prices of our products appearing on this Site are indicated in Euros, inclusive of all taxes but excluding delivery charges, which will be invoiced in addition and will be specified when the order is definitively confirmed.
Prices may vary during the year, it being understood that the products ordered are invoiced at the prices in force when the order is registered.<\/p>

This order and the data recorded by LUCIA RAPETTI constitute proof of the transactions made with you.
However, we reserve the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.<\/p>

ARTICLE 3. METHODS OF PAYMENT<\/b><\/p>

As soon as payment is validated, the order is recorded and becomes irrevocable.
The order form will be recorded on computer registers, which are themselves kept on a reliable and durable medium, and will be considered as proof of the contractual relations between the Parties.
Payment for your purchases on the Site is exclusively in Euros and can only be made by credit card.
Payment by credit card: this is done online when you place your order and is completely secure. You make your purchases in complete security. The entire transaction is encrypted and sent to a bank validation server.<\/p>

ARTICLE 4. DELIVERY<\/b><\/p>

Products are delivered to the address of your choice as indicated during the ordering process. It is your responsibility to provide us with all the details necessary for the correct delivery of your order.
Furthermore, orders must have been validated and paid for on the Site by credit card, before 12 noon, to enable the products to be dispatched the same day, in which case they will be delivered the following day. This being the case, despite all the care taken by LE LABORATOIRE LUCIA RAPETTI in preparing the packages, it is possible that a Product may be missing.
Similarly, after the parcel has been transported, one of the Products may prove to be defective or damaged.
This is why, on receipt of your order, you should check that the products you have received conform to the order. Any anomaly concerning the delivery (missing or broken Product, damaged parcel,) will have imperatively to be notified, the same day of the reception or at the latest the first wrought day following the reception, by mail addressed to LABORATOIRE MGS LUCIA RAPETTI, 170 Avenue de Saint-Est\u00e8ve , ZAC de St Est\u00e8ve, 06640 St Jeannet les plans - France, by e-mail addressed to\u00a0commandes@lucia-rapetti.com<\/span><\/a>\u00a0by telephone on 04 92 12 30 60 (from 9.00 am to 5.00 pm, Monday to Friday. Any claim made after this time will be rejected and the LUCIA RAPETTI laboratory will be released from any liability. Laboratoire LUCIA RAPETTI reserves the right to request the return of the defective Product.
If the aforementioned conditions are met, LE LABORATOIRE LUCIA RAPETTI will then either exchange or reimburse the defective Product(s), or re-ship the missing Product (subject to the buyer's request being well-founded).<\/p>

ARTICLE 5. RETURNS AND REFUNDS<\/b><\/p>

You have the faculty, within 15 days as from the reception of the ordered products, to turn over in its complete packing of origin, with your expenses, the product which would not be appropriate to you, with the address: LABORATOIRE MGS LUCIA RAPETTI, 170 Avenue de Saint-Est\u00e8ve, ZAC de St Est\u00e8ve, 06640 St Jeannet les plans - France.
If the aforementioned conditions are met, the LABORATOIRE MGS LUCIA RAPETTI will change it or reimburse you, depending on your choice.
The refund will be made by bank cheque, within one month of receipt of the returned parcel, to the billing address and in the name of the customer who placed the order, in accordance with the following terms and conditions:
-If you wish to return the product, we will refund the price of the product.
If the product is returned for reasons for which we are responsible, we will reimburse you for the product and any shipping and return costs. No returns for cash on delivery will be accepted, whatever the reason.<\/p>

Force majeure<\/b><\/p>

LABORATOIRE LUCIA RAPETTI will not be responsible for the total or partial non-execution of its obligations under this contract, if this non-execution is caused by an event constituting force majeure, in particular in the event of disturbance or total or partial strike in particular of the postal services and means of transport and\/or communications, flood, fire.
Events meeting the criteria set out in the case law of the 2nd Civil Chamber of the Cour de Cassation will be considered as force majeure.
In the event of an event constituting force majeure, LABORATOIRE LUCIA RAPETTI will notify the user\/purchaser within five (5) working days following the occurrence or threat of this event.
The parties agree that they shall consult each other as soon as possible in order to determine together how the order will be carried out during the period of force majeure.
After a period of one (1) month of interruption for reasons of force majeure, LABORATOIRE LUCIA RAPETTI may not honour the order, at its own expense to reimburse the purchaser if necessary.
Partial invalidity<\/b><\/span><\/p>

If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.
Entire contract<\/b><\/span><\/p>

These general terms and conditions of sale and the order summary sent to the buyer form a contractual whole and constitute the entire contractual relationship between the parties.
In the event of any contradiction between these documents, the General Terms and Conditions of Sale shall prevail.<\/p>

ARTICLE 7. ACCEPTANCE OF THESE GENERAL TERMS AND CONDITIONS<\/b><\/p>

These General Terms and Conditions of Sale and the prices are expressly approved and accepted by the customer, who declares and acknowledges that he\/she is fully aware of them, and therefore waives the right to rely on any contradictory document; the act of purchasing implies acceptance of these General Terms and Conditions of Sale.
These General Terms and Conditions of Sale may be amended at any time without notice; each new version replaces the previous one.<\/p>

ARTICLE 8. APPLICABLE LAW AND JURISDICTION<\/b><\/p>

These General Terms and Conditions of Sale are governed exclusively by French law.
The language of this contract is French.
It is expressly agreed between the parties that any dispute arising from these General Terms and Conditions of Sale shall fall within the exclusive jurisdiction of the competent French courts, in this case our registered office, the address of which is considered to be the place of performance of the service within the meaning of Article 46 of the New Code of Civil Procedure.<\/p>
